Dept. Of Education - Messed Up!
* Had student loans back in the 80s.
* Paid loans and kept copies of all my checks (payments).
* Dept. of Education (DOE) and their hired-gun collection agencies started their steam-rolling collection processes in the late 90s.
* DOE also started confiscating my tax return refunds.
* Sent copies of cancelled checks, front and back, verifying loan payments were made.
* DOE disregarded the cancelled checks, and continued steam-rolling.
* DOE's collection agencies threatened wage garnishment.
* I hired a lawyer to stop collection agencies.
* Also, got US Senator from my home state to address the issues.
* My lawyer sent numerous letters and documentations to the DOE and their collection agencies requesting them to substantiate their numbers and prove their allegations.
* DOE and their collection agencies couldn't substantiate their numbers because their records were either incorrect, nonexistent and/or just screwed up.
* So, I purchased an airline ticket and made a personal trip to Atlanta, GA to see the DOE Ombudsman in an effort to settle the matter.
* Gave the DOE Ombudsman copies of all my records and still no substantiation back from him or the DOE on their position, even after showing them all the original payments (checks).
* At one point, the DOE even tried to allege the cancelled checks were not real.
* The matter has been with my atty. for some 4.5 years now and counting, and still no real answers or actions from the DOE to resolve the matter.
* At one point the DOE idiots said they would settle by waving their crazy collection fees and interest accrued. Hmmmmm, just how do you "settle" a $0 balance account....

Your post about the Board Of Education is a real nightmare! I have read
on a few other forums about people having to pay their student loan
again,despite the fact that they paid it in full! It sounds like some
kind of embezzlement going on. Have you heard of other student loan
borrowers having the same problems as you? I would love to know what
goes on behind closed doors at the Board Of Education. Hopefully, they
will be exposed one day!
DOE Lost Payments
I too have experienced lost payments. Have been in Federal District Court pro se for three years civil no. 03-6091. The response of the Department of Justice,representing DOE, is that records have been lost. This removes the credability of their ongoing collections before the court, it also shows that collections are pursued without necessary documentation thereby falsly representing the character of the dept. A review of your state and federal Fair Debt Collection Practices Acts should provide you with futher actionable claims. I would be interested in receiving copies of your files for possible class action. By pursuing as a class we may toll the statutes of limitations and enhance mometary claims. Have you sent a request for an Administrative Review including specific amount sought including costs/damages by certified mail to DOE? Without having done this first you have not exhausted your administrative remedies and will be bounced out of court before you begin.

NEVER provide confidential information regarding your case to ANYONE other than your attorney whom you have thoroughly checked and verified (including state bar number, and official address and telephone number of record with that bar). Those of us who have truly been harmed by this student loan nightmare need not be harmed again. In so many waves of desparation over YEARS when I find a little hope I do not need a scavenger to dash it again. Our issues are too precious to squander on false representatives...keep tight. My information will go direct to a lawyer I know or a senator or a congressman or congresswoman, etc. Cease and desist preying on the unfortunate but realize we are not weak of fiber.
